17 A September 2nd, I believe I contacted the district 18 attorney concerning this case. 19 Q And why did you contact the district attorney? 20 A No. 1, I wanted to see -- I have never returned a 21 statement to anybody before, never had a person 22 request their statement back. So I called the 23 district attorney to find out if it's proper to give 24 a statement back. 1 Q Okay. And the statement that you're referring to is 2 which statement? 3 A The statement that Jason Longton and Michelle Harris 4 took from Melinda Marcotte. 5 Q Okay. 6 A The district attorney told me it's proper to return 7 a statement. I explained to him the situation with 8 Stacy Crandall being Jason's girlfriend and what I 9 perceived to be a conflict of interest and that I 10 didn't feel he should be working on a case that 11 there is an active personnel complaint against 12 him -- and now he's investigating a guy who's making 13 a personnel complaint against him. So I wanted him 14 brought up to speed on what I was dealing with. 15 Q Okay. And did anything else occur during that 16 conversation? 17 A Basically, no. No. 18 Q And what did the district attorney say to you, if 19 anything? 20 A He said he was okay with it. 21 Q Okay. Did you discuss the allegations against 22 Trevor Downie with the district attorney? 23 A Yes. 24 Q And what did you say to him and what did he say to 1 you about that? 2 A He just listened and I explained that I had a 3 26-year-old female who signed a statement alleging 4 that Trevor Downie had touched her and she wanted 5 her statement back, so she is declining prosecution. 6 And I had a 15-year-old girl who supposedly made an 7 allegation to Officer Longton, which I talked to the 8 parent and the legal guardian of Daughter X, and I 9 told her to contact the New York State Human 10 Rights -- or she could contact New York State Labor 11 Department concerning the child -- the minor child 12 working late hours. I told her she could contact 13 the New York State Human Rights Department to pursue 14 any type of sexual harassment investigation, or she 15 could -- another remedy would be through the EEOC, 16 through the Federal government, to file a complaint 17 with their commission. There are Federal laws and 18 State laws that concern sexual harassment in the 19 workplace. They are civil in nature and I explained 20 to Stacy Crandall how she could go about that, if -- 21 MR. DUNN: I'm going to object to a 22 speech. It's a simple question. 23 HEARING OFFICER: Sustained. 24 BY MS. HAYNES: 1 Q Just with regard to what you spoke to the district 2 attorney about, was there anything else to that 3 conversation? 4 A No. 5 Q And what, if anything, did the district attorney say 6 to you about your conversation? 7 A He just said, okay. That's it. 7 Q Did Jason Longton ever say to you that he was going 8 to act to protect the children? 9 A Yes, he did. 1 to protect the children -- 2 A I don't doubt his sincerity. 17 A Well, we would need a statement from her. We would 18 look for any eyewitnesses to corroborate her 19 statement. We would attempt to get a confession 20 from the alleged offender. 21 Q And did you have a statement from her? 22 A She took her statement back, so we had no statement 23 from her. 24 Q Okay. 1 A And the district attorney was made aware of that.
