I couldn't tell you an exact 11 time. 12 Q Did you know Mr. Jack Lawrence? Do you know who 13 Mr. Jack Lawrence is? 14 A Yes. 15 Q Did you work there when Mr. Lawrence owned Jack's 16 Place? 17 A Yes. 18 Q And at some point in time the restaurant was sold? 19 A Yes. 20 Q And it was sold to Mr. Downie? 21 A Yes. 22 Q Okay. And what did you do at Jack's Place when 5 Mr. Downie owned it? 6 A I was a bus boy. 7 Q So you would clear the tables after the -- 8 A Yes. 9 Q -- diners finished eating? 10 A Yes. 11 Q Now, did Mr. Downie ever do anything to you at the 12 restaurant that was inappropriate, touch you 13 inappropriately or say anything to you 14 inappropriately? 15 A He had touched my shoulder and touched the base of 16 my back, but he just basically touched my shoulder 17 up here, and then the base of my back. It made me 18 feel uncomfortable. 19 Q And it made you feel uncomfortable because you 20 didn't feel it was appropriate for him to touch you 21 that way? 22 A Yes. 23 Q And what did you do about that? Did you do 24 anything? KELLY J. OWENS, COURT REPORTER (518) 798-6598 kjosteno@nycap.rr.com 424 Witness: Daughter X - Direct Examination 1 A I had kept it to myself for a while because I didn't 2 really feel comfortable telling anybody about it. 3 Q At the time -- how old were you at the time? 4 A Fifteen. 5 Q So you felt a little uncomfortable. And did there 6 come a time that you told anyone about it? 7 A Yes. After Officer Longton had come to me a few 8 times and asked me about it over a couple of days 9 and I had finally told him, because I felt 10 uncomfortable about it. 11 Q How did Officer Longton come to you? What did he 12 say? How did that come about? 13 A He had seen me a few times and he had asked me a 14 couple of questions. I don't remember exactly what 15 they were, but he had asked me a couple of questions 16 over a few days. And then I had finally -- I had 17 finally told him about Trevor touching my back and 18 my shoulder. 19 Q Did you tell him how it made you feel? 20 A It made me feel uncomfortable. I told him that. 21 Q And did he say -- do you know when this was, what 22 time of year it was? 23 A I don't remember. 24 Q Do you know whether it was in July, or August, or KELLY J. And did he say he was going to do anything 4 about it? 5 A He said he was going to talk to -- I think he said 6 he was going to talk to Chief Kane about it. I 7 remember. 8 Q And did he ever tell you that he did anything about 9 it? 10 A No. 11 Q Did you at any point in time share what happened to 12 you with your mother? 13 A After I had talked to Officer Longton, yes, but it 14 was a few days after, because I still really didn't 15 feel comfortable about telling anyone about it. 16 Q Were you afraid of losing your job? 17 A Not so much losing my job. Just, it was very 18 uncomfortable for me and I don't like talking to 19 people about things like that. 20 Q Sure. But the first person you told about this was 21 Officer Longton? 22 A Yes. 23 Q Okay. And then the second person you told was your 24 mom? KELLY J.
