1 P R O C E E D I N G S 2 (Village Exhibits 1 through 6 were marked for 3 identification.) 4 HEARING OFFICER: Why don't we go on the 5 record. 6 Good morning, my name is Stephen Conners 7 and I'm the Hearing Officer appointed in this 8 matter. This is the matter brought pursuant to 9 CPLR, Section 75, by the Village of Corinth. 10 The Respondent is Jason W. Longton, Jr., who is 11 present with counsel. This is a re-hearing 12 following an appeal following the first hearing 13 which occurred on or about October 15th, 2004. 14 Present for the Petitioner, we have Attorney 15 Eileen Haynes. Present with the Respondent is 16 Attorney Ronald Dunn. 17 At the request of counsel, I will just 18 recite that, after my receipt of the Decision, 19 Order and Judgment of Judge Nolan, referring 20 the matter for a new hearing, I have had 21 contact on a number of occasions with either 22 counsel, Eileen Haynes, or her office. The 23 sole discussions between my office and hers or 24 between myself and counsel was for the purpose KELLY J. No discussion was 2 had with regard to the merits of the case, with 3 regard to the procedure, or anything other than 4 scheduling the hearing. 5 Does either party wish to be heard with 6 regard to any communication between myself as 7 Hearing Officer and counsel or either side? 8 MR. DUNN: If you could just elaborate and 9 tell us what, if any, conversations you had 10 with any representative of the village on the 11 merits of the case? 12 HEARING OFFICER: Certainly. I can tell 13 you that I'm quite certain that I haven't had 14 any conversation with any representative of the 15 village. I'm aware that Mr. Winslow is the 16 mayor of the village. I have dealt with him on 17 occasion on real estate matters, but I don't 18 think I have had any dealings with him of any 19 kind since the date of this first hearing. The 20 only contact I may have had, or conversation I 21 may have had with any person, Mark Major, who 22 is an attorney, as I understand, for the 23 Respondent, would see me from time to time in 24 court, tell me where he was in the process of KELLY J. But I don't think I have had any 3 conversation with any representative of the 4 village. I don't know any representative of 5 the village, other than the mayor, and, as I 6 said, I don't think I have had any conversation 7 with him of any kind since the date of this 8 hearing.
